PURCHASE AGREEMENT
1. This is a contract for the sale of a pet quality, purebred AKC Miniature Schnauzer. This document concerns a live animal and is executed with prejudice in favor of that animal’s well-being by the undersigned. This is a contract only and shall not be used for, nor construed to be, an application for registration of that animal. This agreement is between Miniature SchnauzersGA, LLC (Breeder/Seller) and Buyer for one puppy as described above.

2. The buyer and seller are subject to all terms and conditions set forth below as follows:

3. The Buyer agrees to assume full responsibility for the animal once it leaves the Seller’s premises. The Buyer agrees to take the puppy to the veterinarian of their choice, at their own expense, within three (3) full business days after taking possession of the puppy, which is the subject of the contract. Buyer must contact Seller immediately upon discovery of any birth defect and/or incurable disease or condition disclosed by Buyer’s veterinarian. This guarantee shall expire three (3) full business days after taking possession of puppy.

4. If satisfied with the veterinarian’s report, Buyer will retain possession of puppy and thereafter hold the Breeder blameless and NOT liable for any further medical condition of said animal.

5. If, during the puppy’s exam by a licensed veterinarian, the puppy is declared to be in an immediate life-threatening condition within three (3) full business days of delivery date, the puppy must be treated and then returned to Miniature SchnauzersGA, LLC, alive within 72 hours of puppy’s discharge, (assuming the veterinarian determines that the puppy is healthy enough to travel), along with written report submitted by the attending veterinarian. We reserve the right to find a 2nd opinion of our choice.

6. Buyer agrees that in the event of the animal’s death with three (3) full business days of possession, the puppy will be taken to a veterinarian for a necropsy. If death is proven to be due to a genetic illness, the puppy will be replaced. All above claims will only be honored with written documentation from a licensed veterinarian.

7. Breeder does not guarantee any health-related issues or loss of life due to reactions caused by vaccinations or flea/tick preparations administered orally or on the skin. Further, any cosmetic surgeries such as ear trims will be at the Buyer’s risk.

8. Buyer pays for all costs involved with the shipping of the returned puppy and the shipping of replacement puppy. Seller is not responsible for any veterinarian or State lab expenses.

9. All puppies sold as Pets. No guarantee will be given to any puppy as to size, color, quality, show ability, disposition, nor fertility. Registration papers will be marked LIMITED. Any offspring from this dog will never be registered with either registry. If for some reason papers are not available at the time the Buyer takes possession of the puppy, they will be sent to the Buyer as soon as they are received. Buyer agrees to continue vaccinations and deworming treatments.

In consideration of the purchase price of TWELVE HUNDRED DOLLARS ($1,200.00), plus shipping (if applicable). A non-refundable deposit of FIVE HUNDRED DOLLARS ($500.00), shall be paid in advance and the balance of SEVEN HUNDRED DOLLARS ($700.00), to be paid by cash, Zelle (no fees) or Credit Card before puppy leaves the Breeder. The balance plus applicable shipping must be paid at least 10 days prior to shipping. NOTE: If you are using Credit Cards to pay any portion of the purchase price of the puppy, you of the total cost. Deposits are non-refundable and non-transferable. In most cases, puppies are ready to leave for their new home at 8 weeks of age, however, it is at the sole discretion of the Breeder. Once the puppy is released, Buyer must take possession within seven (7) days. Failing to do so will result in boarding charges of Fifteen Dollars ($15.00) per day, payable prior to pick-up or shipping of puppy.

The Breeder has the right to cancel this contract and refund the deposit if Breeder feels it is in the best interest of the puppy.

This is a binding contract. By signing this contract and returning it to the Breeder with the deposit, the Buyer agrees that Buyer has read and fully understands the terms and conditions. Any amendments to this contract must be in writing and signed by all parties, oral representations are not binding.
Parties specifically agree and confirm that the proper jurisdiction and venue for any Legal proceedings initiated by either party to enforce or nullify any part, provision or paragraph of this contract or the whole of this contract shall be in HABERSHAM COUNTY, GEORGIA.
